Acceptance and scope
These Terms apply to visitors, customers, account holders, test participants, and anyone acting for a participant. References to “we,” “us,” and “our” mean the business operating PharmacogeneticTesting.us and the service providers used to fulfill an order where the context requires.
Product descriptions, consent forms, collection instructions, checkout disclosures, and written order confirmations form part of the agreement for the applicable service. If test-specific instructions conflict with general website information, the test-specific instructions control for that test.

Eligibility, authority, and informed consent
You must be legally able to enter into a binding agreement to place an order. You must provide accurate information and have lawful authority to arrange testing for every participant included in the order.
- Do not collect, submit, or arrange analysis of another person's sample without the informed consent or other lawful authorization required for that test.
- Where a participant is a minor or lacks legal capacity, authorization from a parent, legal guardian, or another person with lawful authority may be required.
- Required consent forms, identification, provider orders, or supporting documents must be completed before testing can proceed.
- We may decline, suspend, or cancel testing when consent, identity, authority, documentation, or legal eligibility cannot be confirmed.

Orders, prices, and payment
You are responsible for selecting the correct test and reviewing its purpose, sample type, price, shipping charge, report scope, turnaround estimate, and limitations before payment.
An automated order message confirms that the website received your submission; it does not necessarily mean that the order has been finally accepted or that the test is available for your circumstances. We may contact you to correct information, request documentation, confirm eligibility, or offer a refund when an order cannot be fulfilled.
- Prices are shown in U.S. dollars unless stated otherwise.
- Applicable taxes, shipping, courier, replacement, recollection, or optional service charges may be added as disclosed before they are incurred.
- Testing and report release may be withheld until required balances have been paid.
- Insurance reimbursement, HSA/FSA eligibility, or payment by another party is not guaranteed.
- Obvious pricing or product-description errors may be corrected before fulfillment. You will be contacted when a correction materially affects the order.

Kits, fulfillment, and delivery
Collection kits may be prepared and shipped by us or by a laboratory or fulfillment provider working on the order. Shipping methods, charges, estimated delivery, and tracking availability are described during checkout or on the Shipping and Returns page.
- You must provide a complete and accurate delivery address, email address, and telephone number.
- Standard postal service may be used unless another method is selected and paid for.
- Courier delivery may require a separate quotation and payment before dispatch.
- Tracking is provided only when available for the selected delivery method.
- Additional charges may apply when a parcel is returned because of an incorrect address, refusal, failure to collect, or another issue outside our control.
- Shipment estimates are not guaranteed. Delays will be handled in accordance with applicable law.

Collection, labeling, packaging, and sample return
You must follow the collection, labeling, storage, packaging, and return instructions supplied with the specific test. Different tests may use different laboratories and return addresses.
- Use only the sample type and collection materials approved for the selected test.
- Do not use an address from another order or an older kit.
- Return postage is not included unless the product or kit instructions expressly state that it is included.
- Keep a return tracking number until delivery is confirmed when tracked service is used.
- A sample is not considered received merely because it has been mailed.
- We are not responsible for delays, loss, damage, temperature exposure, contamination, or mishandling occurring during return transit to the extent permitted by law.

Laboratory processing, turnaround, and report access
Published turnaround periods are estimates and normally begin when the laboratory receives an acceptable sample and all required documentation. Delivery time, return transit, accessioning, document review, payment issues, recollection, and events outside laboratory control are not included unless expressly stated.
Reports may be delivered by secure portal, laboratory portal, email, downloadable PDF, or another method identified for the product. Certain tests may require you to activate a kit or create an account directly with a laboratory platform.
- You are responsible for maintaining the confidentiality of account credentials and report links.
- You must promptly notify us if you believe a report has been sent to the wrong person or accessed without authorization.
- We may correct clerical, formatting, or verified laboratory errors and issue an amended report when appropriate.
- Reports are supplied in the language and format stated for the service unless another arrangement is confirmed in writing.

Testing limitations and responsible use
No genetic, microbiome, laboratory, or wellness test is infallible. Results depend on the quality and identity of the sample, the variants or markers analyzed, the test method, reference data, current scientific knowledge, and the information supplied with the order.
- A result may be inconclusive, incomplete, unexpected, or require confirmation through another method.
- A negative or low-risk result does not exclude every variant, condition, medication response, or future health issue.
- A predisposition result does not establish that a person currently has or will develop a condition.
- Unless expressly described as a legally admissible service, a test is not intended for court, immigration, custody, inheritance, or another formal legal purpose.
- Reports do not provide emergency care and do not replace individualized medical diagnosis, treatment, prescribing, or professional judgment.
- Do not start, stop, alter, or select medication based solely on a pharmacogenetic result.

Unsuccessful samples, recollection, and retesting
A sample may fail or produce an inconclusive result because of insufficient material, contamination, incorrect collection, labeling errors, storage, transit conditions, biological factors, or laboratory issues.
When a verified laboratory error causes the failure, we will arrange the appropriate corrective action without charging for the repeated laboratory analysis. When the failure is connected to collection, sample quality, contamination, labeling, storage, shipping, missing documentation, or another factor outside the laboratory's control, replacement-kit, shipping, recollection, or retesting charges may apply.

Privacy, laboratories, and service providers
Our Privacy Policy explains how personal information is collected, used, disclosed, stored, and protected. By ordering, you acknowledge that information and samples may need to be shared with laboratories, fulfillment providers, payment processors, technology providers, healthcare professionals, or other parties involved in delivering the selected service.
The applicability of HIPAA and other health-privacy laws depends on the parties and services involved. The health-related nature of a website or report does not by itself mean that every interaction is covered by HIPAA. Review the Privacy Policy and contact us before ordering if a privacy issue is material to your decision.

Cancellations, refunds, and order changes
Contact us promptly when you need to cancel or change an order. Eligibility for cancellation, refund, replacement, or credit may depend on whether payment has been processed, a kit has been prepared or dispatched, third-party costs have been incurred, a kit has been activated, a sample has been received, or laboratory analysis has begun.
Any written refund or cancellation policy displayed during checkout or on the applicable product page forms part of these Terms. Do not return a kit without authorization. Nothing in these Terms limits a refund, cancellation, or other consumer right that cannot lawfully be waived.

Acceptable website and service use
You may use the website only for lawful purposes. You must not:
- submit false identity, consent, health, billing, or shipping information;
- attempt to test a person without required consent or lawful authority;
- use a test or report to harass, discriminate against, impersonate, exploit, or unlawfully investigate another person;
- interfere with the website, accounts, portals, security controls, or service providers;
- copy, scrape, reproduce, resell, or commercially exploit website content without permission; or
- use the service in violation of applicable law or the rights of another person.
We may restrict or terminate access, decline an order, preserve relevant records, or report suspected unlawful activity where reasonably necessary and legally permitted.

Website content and intellectual property
The website design, text, graphics, logos, downloads, educational material, and original content are owned by or licensed to the website operator and are protected by applicable intellectual-property laws. Limited personal use does not transfer ownership or grant permission for commercial reproduction.
Third-party laboratory names, marks, reports, and materials remain the property of their respective owners and may be subject to separate terms.

Service availability, delays, and third parties
Products, laboratories, report formats, scientific content, prices, availability, delivery routes, and estimated turnaround times may change. We may suspend or discontinue a service when required by availability, safety, law, laboratory policy, or operational necessity.
We are not responsible for delay or failure caused by events beyond reasonable control, including postal or courier disruption, severe weather, natural disaster, public-health emergency, labor disruption, system failure, government action, supply shortage, or laboratory interruption. This provision does not remove rights that cannot be limited under applicable law.
Links to third-party websites are provided for convenience. Third parties operate under their own terms and privacy policies.

No guarantee of a particular outcome
We do not guarantee that a test will answer every question, produce a particular finding, qualify for insurance reimbursement, be accepted by a healthcare provider or authority, or lead to a specific medical, legal, financial, or personal outcome.
To the fullest extent permitted by law, the website and services are provided subject to the express descriptions and limitations stated for the applicable product. Nothing in these Terms excludes liability or consumer protections that cannot lawfully be excluded.

Changes to these Terms
We may update these Terms to reflect changes in services, law, technology, laboratories, or business practices. The revised version will be posted with a new “Last updated” date.
Changes apply prospectively unless applicable law or the notice accompanying the change states otherwise. The terms accepted when an order was placed continue to govern that order to the extent required by law.

Applicable law and resolving concerns
These Terms are subject to applicable federal and state law and to any non-waivable consumer rights. Before starting a formal dispute, contact us with the order number, relevant dates, and a clear description of the concern so the matter can be reviewed.
If any part of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion is not a waiver of that provision.
